Das Dekret Nr. 2014-1212 vom 22. September 2014 über das öffentliche Auftragswesen, das mittlerweile aufgehoben wurde, enthielt unbestreitbar bedeutende Fortschritte. Angesichts der aktuellen Lage ist jedoch eine Aktualisierung der Gesetzgebung erforderlich, um den Anforderungen an Transparenz, Schnelligkeit und Einhaltung internationaler Standards im öffentlichen Auftragswesen besser gerecht zu werden und vor allem, um die zahlreichen festgestellten Einschränkungen zu beheben. Das Dekret Nr. 2022-2295 vom 28. Dezember 2022 über das öffentliche Beschaffungswesen enthält daher Neuerungen in Bezug auf die nachhaltige Beschaffung, die verantwortungsvolle Beschaffung, eine bessere Transparenz bei öffentlichen Aufträgen sowie eine Anpassung an die Anforderungen des Programmbudgets.
