English summary: The liberalization of public services is subject to heated political debate. Sven Simon analyzes the liberalization structure in the two relevant treaties and explores the question of whether or not public services are inevitably subject to liberalization in WTO or EU law. He addresses the complex constitution of the GATS, discusses the scope of the application as well as the potential justification for restrictions with regard to the single market in the EC Treaty, and evaluates the effects of the new protocol concerning public services included in the Lisbon Treaty. The results of his interpretation are presented in a wider socio-economic and political context, and accordingly show how international and European law can contribute to introducing notions of public welfare into the process of globalization. Sven Simon analysiert die Liberalisierungsstruktur der beiden massgeblichen Vertrage und geht der Frage nach, ob Dienstleistungen der Daseinsvorsorge im WTO- oder EU-Recht einem Liberalisierungszwang unterworfen sind. Er setzt sich mit der komplexen Struktur des GATS auseinander, erortert den Anwendungsbereich sowie die Rechtfertigungsmoglichkeit binnenmarktrechtlicher Beschrankungen des EG-Vertrages und bewertet die Auswirkungen des Protokolls zur Daseinsvorsorge im Vertrag von Lissabon. Das Untersuchungsergebnis stellt er in einen breiteren soziookonomischen und politischen Kontext.
