Es ist jedoch zu betonen, dass der Schwerpunkt dieses Grundsatzes auf einem seiner "Gesichter" liegt, nämlich dem Grundsatz des Verbots des unzureichenden Schutzes. Sie befasst sich auch mit dem so genannten Garantismus, wobei nicht nur seine negative Seite, die bekannter ist und manchmal als die einzige angesehen wird, sondern auch seine positive Seite behandelt wird, die nicht so weit verbreitet ist, deren Anwendung in der brasilianischen Doktrin und Rechtsprechung aber immer mehr an Bedeutung gewinnt.
